Entering data into publicly offered artificial intelligence (AI) systems is considered a transfer to third parties and is therefore not permitted. An AI system is a machine-based system designed to operate with varying levels of autonomy (AI Act Art. 3 No. 1). AI systems at the sole disposal of the data-using institution, over which the data-using institution has control, which do not store the data or derivatives outside the controlled environment, and which are used exclusively for scientific purposes, may be approved in individual cases upon request.
